These Terms of Service ("Agreement") govern your use of the Creative Societe website and the services provided by Creative Societe ("Content Creator"). By accessing or using our website and services, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use our website or services.

Services

Creative Societe agrees to provide wedding & event content creation services as described on our website. Our services include capturing raw and candid iPhone footage of the wedding ceremony, reception, and other events as agreed upon. We will exercise our professional judgment and expertise to determine the style, angles, and footage that will be captured.

Quotation

Unless stated in writing Creative Societe’s quotation will be valid for a period of up to seven (7) days from date of issue. Acceptance of the quotation is subject to written confirmation and payment of deposit.

Payment

You agree to pay Creative Societe a 25% non-refundable deposit at the time of booking, which will be applied towards the total cost of the content creation services. The remaining balance is due no later than two (2) weeks (14 days) prior to the event date.

No booking is confirmed until deposit is received.

All payments must be received before any work is commenced.

Cancellations and Variation of Services

In the event of a cancellation by the client outside three (3) months prior to the event date, the deposit will be retained by Creative Societe as a cancellation fee.

In the event of a cancellation by the client within three (3) months of the event date, will incur a cancellation fee of %100 of the original contract price.

No variation of a booking will result in a reduction of the contract price by more than 10%. Where the client seeks to vary a booking so that the original contract price by more than 10%, the client agrees to pay 90% of the original contract price regardless of the variation requested, prior to any work commencing.

Travel

Travel costs will be added to the booking. Costs vary depending on event location, start time and finish time.

Events on or surrounding a public holiday may incur surcharges.

Creative Societe travels up to three (3) hours from Sydney by road.

Creative Societe may offer complimentary destination wedding content creation services when travel arrangements are covered in full by the client. T&C’s apply.

Rights

Creative Societe retains all rights to the footage captured during the wedding and/or events, including raw and edited footage. You may use the footage for personal use only, such as sharing with family and friends. Commercial use of the footage is strictly prohibited without written consent from Creative Societe.

Editing and Delivery

We will deliver all raw and unedited footage captured during the wedding and/or event to you within 24 hours of event departure. Any social media edits will be delivered within 7-10 days of your event. You will receive edited videos, as described on our website, in the content collection of your choosing. Creative Societe reserves the right to make editorial decisions and make changes to the final product as deemed necessary.

Liability

While we make every effort to capture high-quality raw & candid footage, we cannot be held responsible for factors beyond our control, such as weather conditions, lighting, or equipment malfunction. In the event that we are unable to provide the agreed-upon services, our liability is limited to a full refund of any payments received.

Copyright

Creative Societe retains all copyright to the footage captured during the wedding and/or event. You may not modify, reproduce, or distribute the footage without our written consent.

Governing Law

This Agreement is governed by the laws of the state of New South Wales, Australia. Any disputes arising from this Agreement shall be resolved through arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

Entire Agreement

This Agreement constitutes the entire agreement between you and Creative Societe. Any amendments to this Agreement must be made in writing and signed by both parties.

By using our website or engaging our services, you acknowledge that you have read and understood these terms and agree to be bound by them.
